Ziele, Inhalte und Methode der Lehrveranstaltung

In diesem Seminar werden Grundkonzepte des internationalen Investitionsrechts im Hinblick auf Rechtsstaatlichkeitskriterien untersucht.
Dabei geht es einerseits um die Frage inwieweit Schutzstandards wie die gerechte und billige Behandlung (Fair and Equitable Treatment), die Gewährleistung von vollen und ständigen Schutz, die Nichtdiskriminierungsstandards sowie der Schutz gegen entschädigungslose Enteignungen Elemente der Rechtsstaatlichkeit widerspiegeln. Ebenso sollen die in der aktuellen Debatte um Investitionsschutzkapitel (wie etwa in CETA, TTIP) aufgeworfenen Fragen, ob das derzeitige System der Investitionsschiedsgerichtsbarkeit Kriterien der Rechtsstaatlichkeit entspricht, untersucht werden.

Die Teilnehmenden werden ersucht ein Thema aus der untern stehenden Liste zu wählen.

• The rule of law component inherent in the non-discrimination standards of MFN and national treatment
• Fair and Equitable Treatment – rule of law components

• Expropriation – rule of law components (Non-discrimination and due process)
