Ziele, Inhalte und Methode der Lehrveranstaltung
This seminar will provide doctoral students, diploma students and LLB/LLM students with an opportunity to explore conflict-of-laws issues in international arbitration in depth. The general topic of the seminar focuses on the law applicable to the merits (the lex causae) in international arbitration. Inter alia, student research may cover: A comparative analysis of the applicable conflict-of-laws rules, limits on party autonomy, the scope of the law governing the merits, the role of mandatory law, the application of non-state legal rules, or issues with the identification or application of substantive law in arbitral proceedings.
Art der Leistungskontrolle und erlaubte Hilfsmittel
Students will be graded on the basis of their submitted research paper, the oral presentation and their participation in the discussion.
Mindestanforderungen und Beurteilungsmaßstab
The seminar is open to doctoral students, diploma students, and IREWI students (LLB and LLM).
Some knowledge of international commercial arbitration is recommended. Students with no prior exposure to international arbitration are strongly encouraged to participate in the lecture „030403 VO International Commercial Arbitration“ during the winter semester.
In particular, the assessment criteria include: Comprehensive coverage of the individual topic and degree of research, as well as the comprehensibility, persuasiveness and originality of the conducted research.
