Ziele, Inhalte und Methode der Lehrveranstaltung

This course offers an in-depth exploration of the legal frameworks governing sanctions in international and European law, with a primary focus on United Nations (UN) and European Union (EU) sanctions. Students will gain a comprehensive understanding of how sanctions function as instruments of international law and diplomacy, influencing the international response of states to international conflicts.

While our focus is on UN and EU sanctions, we will also consider the legal framework for sanctions in the United States (US) and the United Kingdom (UK). We discuss US sanctions, administered by the Office of Foreign Assets Control (OFAC), in terms of how they affect EU operators and measures by the EU in response. UK sanctions, particularly post-Brexit, will be examined in terms of how the Office of Financial Sanctions Implementation (OFSI) manages sanctions, highlighting areas where UK sanctions align with or diverge from EU sanctions.

Through interactive discussion, case studies, and insights from legal practitioners, students will critically assess the legal effectiveness and limitations of sanctions as tools of foreign policy. By the end of the course, students will be able to analyze sanctions within the framework of international and European law and evaluate their broader impact on global governance, international relations, and diplomacy.

Art der Leistungskontrolle und erlaubte Hilfsmittel

Students may not miss more than 2 classes over the course of the semester without permission. There is no need to notify service.int-law2@univie.ac.at about absences within this limit.

Grades are based on class participation, a one-week take-home EU sanctions mock case, and a response paper.

Mindestanforderungen und Beurteilungsmaßstab

Class Participation: 40%

Seminars will be interactive, with students expected to engage in discussions of the assigned readings and case studies. Participation will count for 40% of the final grade.

One-Week Take-Home EU Sanctions Mock Case (Open Book): 30%

Students will complete a one-week take-home mock case focused on EU sanctions, completed on an open-book basis. This assessment will count for 30% of the final grade.

One Reflection Paper: 30%

To stimulate discussion and reflection, participants will write one reflection paper related to a seminar/topic covered during the semester. A reflection paper can consist of any or all of critique, summary, elaboration, expressions of disagreement or puzzlement, suggestions for further inquiry, and so on—so long as it is directed to the relevant seminar materials.

The reflection paper should be 1000 words long and needs to be uploaded via Moodle 48 hours prior to the relevant seminar (or the deadline specified by the instructor). It must include the participant’s name, email address, and word count. This assessment will count for 30% of the final grade.
