Ziele, Inhalte und Methode der Lehrveranstaltung

Commercial conflict of laws is a vital area of legal scholarship and practice. This course aims to explore the foundational principles of the subject from the perspective of common law jurisdictions. We will begin by examining how common law courts determine whether to assume jurisdiction in international commercial disputes. We will then consider the common law rules governing the recognition and enforcement of foreign judgments. Finally, we will analyse the choice‑of‑law rules that apply to cross‑border private disputes.

Mindestanforderungen und Beurteilungsmaßstab

At the completion of the module, students should be able to:

• demonstrate an understanding of the conceptual framework which shapes the court-based resolution of international commercial disputes;
• show an appreciation of the principles based on which common law courts respond to some of the fundamental questions in the field of conflict of laws; and
• apply their knowledge of the relevant legal principles gained during their studies to potentially uncertain situations.

The award of marks of the oral exam is based on the correctness, completeness, and degree of precision of the answers.
