Aims, contents and method of the course

Ziele: Vermittlung von Grundzügen des Internationalen Deliktsrechts. Wie bestimmte ich das anwendbare Recht für außervertragliche Schadenersatzansprüche (Delikt)?
Inhalt: Ausgewählte Rechtsfragen des Internationalen Deliktsrechts - allgemeines Deliktsstatut (Art 4 Rom II-VO), Rechtswahl (Art 14 Rom II-VO), Verletzung der Privatsphäre oder der Persönlichkeitsrechte (zB Online-Medien), Straßenverkehrsunfall mit Auslandsbezug (HStVÜ, Rom II-VO), internationale Produkthaftung (Art 5 Rom II-VO), internationale Umwelthaftung (Art 7 Rom II-VO).
Methode: Präsentation der Themen anhand von Fällen unter Berücksichtigung von Judikatur, Mitarbeit und Diskussion.

Assessment and permitted materials

Mitarbeit und Klausur; es besteht Anwesenheitspflicht.
Hilfsmittel: Gesetzestext.

Minimum requirements and assessment criteria

Beurteilungsmaßstab: Positive Beurteilung bei Erreichen von 51% der Gesamtpunkteanzahl. Davon können Sie bei den einzelnen Leistungskontrollen erlangen: Klausur: 55%, Mitarbeit: 45%.
