Information

Aims, contents and method of the course

The principle ‘rule of law’ can be understood as implying principles such as the legality of the exercise of state authority, effective judicial protection, fair trial as well as the protection of legitimate expectations. In this seminar, it will be examined to what extent these principles are guaranteed in Austrian constitutional law. In the course of this, not only the provisions of the Austrian ‘Bundes-Verfassungsgesetz’ (B-VG) and the ‘Staatsgrundgesetz’ (StGG) but also Art 6 ECHR and Art 47 CFR (which can according to the case-law of the Austrian Constitutional Court to a certain extent be regarded as a constitutionally guaranteed right) are to be considered. The participants are requested to choose a topic from the list below.
