Aims, contents and method of the course
Assessment and permitted materials
• The aim is for all students to take their turn as examiners and examinees during the exercise. Whether this is achieved ultimately depends on the number of registrations and the progress of the discussion in the exercise.
• Grading is based on the performance provided in the exercise as examiner/examinee for the assigned case(s). For a positive overall grade, the oral performance must be completed and be positive.
• Students who did not take their turn as both examiner and examinee in the exercise may prepare their three examination questions and the corresponding answers together (examiner/examinee) on a maximum of 2 pages in writing and submit them by e-mail within one week. The grading is then based on this joint elaboration.More information in the preliminary meeting.

• Approximately four weeks before the start of the exercise (= shortly after the preliminary meeting), each student will receive one or two press releases from the CJEU via Moodle for preparation. The preparation takes place at home.
• He/she acts as an examiner for these press releases.
o The examiner must prepare three questions for the press release: The first is always about the type of procedure, the other two about the subject matter.
o The questions should be within the scope of Prof. Jaeger's material delimitation. They should therefore neither be too easy nor go beyond the subject matter (e.g. no secondary law that is not asked, but secondary law that is asked according to Prof. Jaeger's subject matter).
o It is not important for the examiner to discuss or solve the case as completely or correctly as it is described in the press release, but as it can be recognized from the head of the press release (file number, parties, headnote) (i.e. as in the real examination situation)!
o E.g. case on the free movement of goods = realistic examination questions on the free movement of goods according to difficulty, but not necessarily what the case is about. In fact, the text of the press release can even be disregarded when preparing the questions.
• All students are also examinees.
o They will be given the number of the press release by the examiners. It is accessed online by the examinees via the CJEU website.
o The questions on the case prepared by the examiners are then asked and the candidates have to answer them to the best of their ability (without any special preparation time).
o The examiners check and comment on the correctness of the answers given.
• At the end of each examination discussion, the discussion is commented on and discussed by the course instructor and the other students.
• The allocation of who will be examined for which case will only take place during the exercise and at random. Each student should appear once as the examiner and once as the examinee.
• The duration of the examination and the depth of the questions will depend on the number of participants in the exercise and will be determined during the exercise.
