Information

Aims, contents and method of the course

The course focuses in particular on the development of state and catholic-ecclesiastical matrimonial law. The matrimonial law systems and positions of other churches as well as the matrimonial law principles of Jewish and Islamic law will also be considered. In all these questions, the changing relationship between the Austrian state and the religious communities is also taken into account.
For the development of state matrimonial law, the Josephinian matrimonial law, the matrimonial law of the ABGB, the 1938 Matrimonial Act and its amendments in the Seventies of the 20th century form a milestone. In addition, recent developments that shape the current legal situation (Registered Partnership Act; same-sex marriage) are also dealt with. Special consideration is also given to the recent jurisdiction of the Constitutional Court. Furthermore, relevant provisions of the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union are examined.

Assessment and permitted materials

Compulsory attendance, oral collaboration, presentation of 20 minutes.
A written assignment has to be drawn up by graduands and doctoral students.

Minimum requirements and assessment criteria

Students who do not comply with the compulsory attendance in a noticeable way ore are not present at the first course unit without a valid excuse will be deregistered. If there is a minor extent of attendance an additional oral colloquium can be demanded.

Examination topics

Primarily depending on the presentation topic.

Reading list

A course-document will enable an initial introduction to the literature. This document willbe uploaded in an updated version on the moodle plattform after the preliminary discussion.
Nevertheless, independent research is an essential part of the course and influences the final score.
