Information

Aims, contents and method of the course

The course offers a comprehensive presentation of Austrian hospital law („Krankenanstaltenrecht“), the amendments by the "Healthcare reform" of 2024 will be taken into account. The focus will be on the regulations of the federal law on hospitals and health resorts („Bundesgesetz über Kranken- und Kuranstalten“ - KAKuG) and its provincial implementation regulations (including the term „hospital“, types of hospitals, establishment and operating licence, organisation, operating regulations, financing of hospitals).
The course can (but does not have to) be combined with the course by Prof. Mazal in the winter term (Labour Law in Hospitals).

Assessment and permitted materials

Regular oral participation during the course and written final test (on campus). The test will be open book, collaboration during the test is not permitted.
Resources: unannotated editions of the law, course materials.
Attendance is compulsory. Two unexcused absences are permitted.

Examination topics

Lecture notes and slides provided by the lecturer (in German). Case studies and joint discussion during the lecture.

The course instructor will provide a short script. In addition: Kopetzki, Krankenanstaltenrecht, in Holoubek/Potacs (Eds), Öffentliches Wirtschaftsrecht I (4. Edition 2019) 431. This article is available to all students via the Verlag Österreich e-library. For specific questions see the commentary to the Austrian Hospital Act in "Gmundner Kommentar zum Gesundheitsrecht" (2nd edition 2022). This commentary is available to all students via the RDB database.
