Ziele, Inhalte und Methode der Lehrveranstaltung

This course introduces students to the case method, which is so characteristic of the Germanic legal family and university teaching in German-speaking countries. This method is a necessary prerequisite for passing written exams in Austrian civil law. Experience shows that students who come from a legal system outside the Germanic legal family have great difficulty with this method. The course will provide them with the necessary theoretical tools, including detailed schematic structures, to solve cases at an advanced level (such as FÜM II). At the same time, the course may also be useful for Austrian students who wish to learn the appropriate English terminology for core concepts of Austrian civil law, which is an essential skill when dealing, for example, with clients from abroad.

One online exam/term paper or collaboration during the course.

Mindestanforderungen und Beurteilungsmaßstab

Students must complete an online exam/term paper and actively participate during the course to successfully complete the course. The online exam/term paper will require students to apply the skills they have acquired to solve a case that will be made available online on Moodle.
Students in the course will be graded with a + (positively completed) or - (failed/not completed). To receive a positive grade, students must complete the online exam/term paper or actively participate during the course.
In order to pass the course, students must make a contribution in at least one of two ways (examination/assignment with a positive mark or oral participation). Oral participation is given if at least one significant oral contribution is made. It is the responsibility of each student to ensure that their oral participation is properly recorded.
