Ziele, Inhalte und Methode der Lehrveranstaltung
The international transfer of legal concepts and principles is often interrelated with global power structures. From colonialism onwards, the global center has developed different forms and channels of legal influence on the periphery. The idea of the superiority of the so called West contrary to the backwardness of so called developing countries plays an important role in these processes. With reference to concrete examples of legal transplants in Latin America, above all Mexico, we will discuss the different forms of legal influence, the transferred legal concepts, their political impact and their relation to global power. Theories developed by Ugo Mattei and Laura Nader about plunder, the political function of the rule of law and imperial law will be the central theoretical reference point. The Nobel Peace Prize Speech of President Barack Obama and the recently released documentary "Crude. The real price of oil" (which got several awards) will be used as an imput for discussion. Prüfungsstoff
This course focuses on discussion in class. This discussion shall take place on the basis of reading material which will be provided at the department of comparative law. Students are supposed to write a paper of 5 pages discussing certain questions referring to the reader until 7 of December 2010. In course of the classes the same questions shall be discussed with reference to these papers and the reading material. There will be no further exam. Participation in class is necessary. The grade depends on the paper and on oral contribution in class.
