Ziele, Inhalte und Methode der Lehrveranstaltung

The international transfer of legal concepts and principles is often interrelated with global power structures. From colonialism onwards, the global center has developed different forms and channels of legal influence on the periphery. The idea of the superiority of the so called West contrary to the backwardness of so called developing countries plays an important role in these processes. With reference to concrete examples of legal transplants in Latin America, above all Mexico, we will discuss the different forms of legal influence, the transferred legal concepts, their political impact and their relation to global power. Theories developed by Ugo Mattei and Laura Nader about plunder, the political function of the rule of law and imperial law will be the central theoretical reference point. The Nobel Peace Prize Speech of President Barack Obama and the documentary "Crude. The real price of oil" (which got several awards) will be used as an imput for discussion.
