Ziele, Inhalte und Methode der Lehrveranstaltung

The aim of this introductory course is to familiarize students with the international dimension of the law early in their legal studies. Increasingly, states are unable to solve their political, economic, technical, social or other issues by themselves or solely within their borders. Understanding domestic law thus also requires a knowledge of international law.

The lecture is taught in English in the winter semester, and in German in the summer semester. At least one practical exercise course in English and in German is offered each semester to ensure that students in the diploma degree and the IREWI degree benefit from instruction in the language of their exam in each semester.

The examiners strongly encourage students to enrol in a practical exercise course. In addition to increasing the understanding of the subject and the ability to apply principles and rules of international law, successfully completing a practical exercise course is crucial for the exam. Around 75 percent of students who successfully complete a practical exercise course pass the exam, and fewer than 20 percent of students pass the exam without a practical exercise course.

The scope of "Fundamentals of International Law" is set out in:- Teaching Materials, “Introduction to International Law / Foundations of Public International Law“, 6th edition, 2023 (or alternatively, the German teaching materials with the same coverage “Einführung in die Internationalen Grundlagen des Rechts: Einführung in das Völkerrecht“, 6th edition 2023), both available at the “Facultas Jus-shop“, Juridicum, ground floor or online https://www.facultas.at/juridicum.- Introductory lecture: the slides for this course are available on the Moodle platform (you need to be registered for course 030477 to access the slides).

For the European law part, the following material delimitation applies: The subject of the MP "Introduction to International Law - European Law Part" is the main features of formal and substantive European law. It is about understanding as well as mastering the basics of European Union law. The material covers the script by Thomas Jaeger, "Introduction to European Union Law, Foundations - Institutions - Enforcement - Internal Market Rules" (2021). Alternatively, the German-language script by Thomas Jaeger, Einführung in das Europarecht (3rd ed., facultas, 2020) can be used for exam preparation.

Mindestanforderungen und Beurteilungsmaßstab

The parameters of the exam differ for diploma and IREWI students.

· For further information on the FÜM I exam, see https://eur-int-comp-law.univie.ac.at/pruefungen/fuem-i/. This exam in German lasts three hours. For a passing score you need a minimum of 80 out of 180 points. Additionally, you need a minimum score for every single part: Roman Foundations - 40 out of 120 possible points, International Law/European Law – 12 out 30 possible points.

· For further information on Introduction to International Law (IREWI) - European Law, see https://eur-int-comp-law.univie.ac.at/en/exams/irewi-written-module-examination-introduction-to-international-law/. This exam in English lasts 60 minutes. For a passing score a minimum of 30 out of 60 points is required. Additionally, a minimum score of 15 points must be achieved in each part.
