Prüfungsimmanente Lehrveranstaltung

The course aims at training students to apply principles of EU law to concrete cases. The course aims at achieving such objective by analyzing selected judgments of the Court of Justice of the European Union (CJEU) and by discussing hypothetical cases of application of EU law (i.e. mock cases). Selected CJEU judgments in the areas of constitutional principles of EU law, judicial protection of EU rights and EU internal market law will be discussed during the classes. In the final exam students will be asked to solve a mock case, in order to show their ability to apply principles of EU law to concrete cases

Students are required to be regularly enrolled on Univis, at least on the waiting list. Erasmus/exchange students are invited to contact the Dekanat of the Law Faculty if they do not manage to enrol on Univis in due time. Art der Leistungskontrolle und erlaubte Hilfsmittel

Students are required to read the selected judgments of the Court of Justice of the European Union (CJEU) and EU legislation uploaded on Moodle before each class. Each class will include a discussion of the selected CJEU judgments, as well as the analysis of a mock case similar to the case assigned in the written exam.

The assessment is based on a final written exam, where students will be asked to solve a mock case, similar to those ones previously discussed in the previous classes. During the written exam, students will be able to consult the text of the CJEU judgments and Treaty provisions/EU legislation uploaded on Moodle, provided that the latter are printed and not marked without any personal note. Textbooks and the slides of the lectures are not allowed during the written exam. No electronic devices are allowed during the written exam.

Students who actively participate in the class by summarizing the facts and the content of one of the judgments or solving one of the mock cases assigned for the class will receive a +. Every + will increase the final grade of 0.25 points, up to a maximum of 1 point.

Literatur

Students are required to read the selected CJEU judgments and EU legislation uploaded on Moodle before each class.

The course takes for granted a basic knowledge of the functioning of the EU institutions and decision-making procedures. Students who have not previously attended any class of EU law are encouraged to read the textbook Essential EU Law in Text. This textbook provides in a schematic manner an introduction to EU law.
