Ziele, Inhalte und Methode der Lehrveranstaltung

The course aims at training students to apply principles of EU law to concrete cases. The course aims at achieving such objective by analyzing selected judgments of the Court of Justice of the European Union (CJEU) and by discussing hypothetical cases of application of EU law (i.e. mock cases). Selected CJEU judgments in the areas of constitutional principles of EU law, judicial protection of EU rights and EU internal market law will be discussed during the classes. In addition, students will be asked to solve mock cases, in order to show their ability to apply principles of EU law to concrete cases.

Art der Leistungskontrolle und erlaubte Hilfsmittel

The mock case in the final exam is divided in 4 questions, essay style. Students have to reply to every question referring to the relevant CJEU judgments and legislations discussed in the class, and to apply the relevant provisions/case law to the facts of the mock case.

Students who actively participate in the class by summarizing the facts and the content of one of the judgments or solving one of the mock cases assigned for the class will receive a +. Every + will increase the final grade of 0.25 points, up to a maximum of 1 point.

Mindestanforderungen und Beurteilungsmaßstab

Students are required to attend every class of the course and sign the attendance list distributed during each class. A maximum number of 2 absences will be tolerated per student.

Students who skip more than 2 classes due to prolonged sickness should submit the medical krankmedung to the lecturer. In such case, the absence will not be counted. No other justification will be tolerated (i.e. jobs related reasons).

Students are required to be enrolled on U:space, at least on the waiting list.

Prüfungsstoff

Students are required to read the selected CJEU judgments and EU legislation uploaded on Moodle before each class. Each class will include a discussion of the selected CJEU judgments, as well as the analysis of a mock case similar to the case assigned in the written exam.

Literatur

The course takes for granted a basic knowledge of the functioning of the EU institutions and decision-making procedures. Students who have not previously attended any class of EU law are encouraged to read the textbook Essential EU Law in Text. This textbook provides in a schematic manner an introduction to EU law.
