Contents:
The course deals with main areas of European labour and social security law focusing on the special impact of the Union. In the area of labour law, it examines freedom of workers, anti-discrimination (esp. age discrimination), minimum standards in labour law (esp. working time, fixed-term contracts, transfer of undertakings), legislation and rulings with an integrationist rationale (EWC, posting of workers, ECJ rulings in the Laval, Viking and Rüffert cases). With regard to social security law, the course examines the increasing influence of EU law on the Member States’ ability to shape their social system: Coordination rules; duty to export benefits (freedom of services) and to integrate migrants into the national system (citizenship); influence of the freedoms and competition law on the organisation of social security. For both areas, also the soft Open Method of Coordination will be explored (e.g. employability and flexicurity approach).
