Aims, contents and method of the course

Objectives:
The students learn about the principles and possible applications of business mediation in Austria.

The participants understand the process and structure of the mediation procedure.

They can assess when and how intra- and inter-company business mediation can be used effectively and efficiently, also in comparison to other conflict management procedures.

The students have practised important prerequisites and tools of mediation such as active listening and formulating open questions.

Contents:

Business mediation is introduced as an innovative conflict management procedure for conflicts in and between organisations. The special features of business mediation as well as the tasks, rights and obligations of the mediators and mediandes (parties) are elaborated. The differences and similarities to other company/organisational conflict management procedures are also highlighted.

The legal provisions for business mediation in Austria are explored as well as the practical and actually used fields of application based on examples from the internal area such as so-called apprentice mediation and mediation according to the Disabled Persons Employment Act. The different perspectives of employers and employees will be highlighted in particular. On the inter-company level, we will look at the spectrum of mediation and hybrid procedures, for example, the Viennese mediation rules of the VIAC and pilot projects for business mediation at Austrian courts.

Beyond these levels of content, we work with each other in dialogue in the course, both in the plenary and in the small groups. Dialogue versus debate as an attitude, method and procedure will be tried out together. Case studies are both discussed and practically experienced in a simulation as well as role plays.

Minimum requirements and assessment criteria

P1/3: Active participation in the course: qualitative and quantitative contributions to the discussion, dialogue and cooperation with colleagues, participation in exercises.
1/3: Quality of group presentation: oral and written
1/3: annotated minutes of the course (group work)
