Information

Aims, contents and method of the course

After a short introduction concerning alternative measures in penal law some international restorative justice-projects will be presented.
Then a survey about the various provisions of "Diversion" will be given and the matter of indication of the various diversional measures will be discussed on the basis of special cases.
After this the issue of mediation in general and mediation in penal matters will be treated.
Finally the different techniques of the "Tatausgleich" will be presented by means of practical examples.

Particular attention will be turned to the practical relevance of mediation in penal matters.

Minimum requirements and assessment criteria

Overview about alternative sanctions on a national and international level. Special knowledge about the legal norms of diversion, correct utilisation of the various diversional measures (according to the indication), knowledge about mediation in general and the special attributes of mediation in penal matters, gaining insight into theoretical and practical requirements of the Tatausgleich.

Examination topics

Power point presentation, discussion, intergroup development (presentation on the flip chard), role play, written survey amongst the students about self reported delinquency
