Aims, contents and method of the course

The students will gain an insight into the practical work in a legal dispute and the decision-making processes behind it. At the end of the course, students should have an overview of the advantages and disadvantages of different conflict resolution mechanisms. Practical and strategic considerations of contentious civil proceedings will also be presented in particular. Students will consider the position of the legal representative and the parties in the preparation of litigation and from this position develop a sense of when formal litigation, when out-of-court negotiations and when mediation are appropriate.
Among other things, as a contrast to a cooperative negotiation style, students will also deal with the requirements and difficulties of building a contentious legal position and learn to analyse an issue for opportunities and risks.

Assessment and permitted materials

One written assignment, oral participation, all aids allowed.

Minimum requirements and assessment criteria

Minimum requirements: Full attendance, positive assessment of both the written assignment and the oral participation; advanced knowledge of civil procedure and civil law is recommended; the final assessment is made up of 50% written assignment and 50% oral assessment.
