Information
Aims, contents and method of the course
Digital assets such as cryptocurrencies or non-fungible tokens (NFT) are on the rise worldwide. Especially as an investment product, they have already become extremely important. As a result, digital assets are naturally also of interest to creditors, as they represent assets of equal value in execution and insolvency proceedings. Nevertheless, neither execution law nor insolvency law has yet taken the specifics of digital assets into account through corresponding special provisions. The seminar aims to identify and discuss the relevant problems. The thematic view will not be limited to the Austrian legal system, but will (also) look beyond the Austrian legal system. Thus, the recent legislative efforts of UNIDROIT ("Draft UNIDROIT Principles on Digital Assets and Private Law") will also be taken into account. The aim of the course is to learn how to independently analyse and present legal problems by writing and presenting a seminar paper.
