Information

Aims, contents and method of the course

Digital assets such as cryptocurrencies or non-fungible tokens (NFT) are on the rise worldwide. Especially as an investment product, they have already become extremely important. As a result, digital assets are naturally also of interest to creditors, as they represent assets of equal value in execution and insolvency proceedings. Nevertheless, neither execution law nor insolvency law has yet taken the specifics of digital assets into account through corresponding special provisions.

The seminar aims to identify and discuss the relevant problems. The thematic view will not be limited to the Austrian legal system, but will (also) look beyond the Austrian legal system. Thus, the recent legislative efforts of UNIDROIT ("Draft UNIDROIT Principles on Digital Assets and Private Law") will also be taken into account.

The aim of the course is to learn how to independently analyse and present legal problems by writing and presenting a seminar paper.

Assessment and permitted materials

All entries will be assessed, all resources are allowed.

Minimum requirements and assessment criteria

Minimum requirements and assessment standard:

Seminar paper of approx. 20-25 pages (if the paper is to be submitted as a thesis seminar paper: min. 50,000 characters, excl. table of contents, list of abbreviations and bibliography).

Short presentation of 15-20 minutes, with handout or transparencies

Attendance during the entire seminar

Submission of the final version of the seminar paper by the end of the semester.

The seminar grade is based on equal weighting of oral (presentation, participation) and written performance (seminar paper). The diploma thesis seminar grade evaluates only the written seminar paper.

Examination topics

An examination on the material is not foreseen within the framework of a seminar.

Reading list

The literature relevant to the topic is compiled within the framework of independent research. The course instructor offers various forms of assistance (research tutorials, etc.).
