Information

Aims, contents and method of the course

The course focuses on international and European Migration Law, excluding Refugee Law. Instead, it examines other forms of cross-border mobility and their legal regulation, including labour migration, family migration, citizenship law, statelessness, and European citizenship. Throughout the course, we will evaluate the role of international law, especially human rights law, in these mobility regimes. We will pay particular attention to legal provisions that require equal treatment and prohibit racial and ethnic discrimination.

Learning goals:
By the end of the course, students are expected to be able to:
• Describe the regulatory structure of EU asylum migration law and international regulation of (non-refugee) migration.
• Identify and describe the main sources and principles of international and European migration law.
• Explain and illustrate the relevance of European and international human rights law in this area.
• Give an account of and analyse the principles and main rules governing entry and residence in EU member states for family members of third-country nationals and migrant workers.
• Apply the European and international rules to concrete cases, and assess the possible effects of these rules in the domestic law of member states.
• Effectively communicate acquired knowledge and skills in a structured manner using well-formed English.

Method:
Mostly interactive, combining short input by the professor, students' participation in discussions and brief oral presentations prepared in groups. Students are expected to read and prepare European and international case law, legal materials, and scientific articles for their oral presentations.

Assessment and permitted materials

• Class attendance and participation (25%)
• Preparation of 2 reflection questions per class and participation in its oral discussion (25%)
• Presentation of a research topic in groups, including a written statement about the methods applied and the contributions by each student in the group (50%)

USE OF AI SOFTWARE:
You can use AI programs to prepare your presentations. However, if you do so, you must disclose this and in particular which “prompts” you have entered and how you have checked the accuracy of the results for accuracy. Minimum requirements and assessment criteria

- Positive group presentation that presents the topic correctly and critically assesses it in the light of the literature. The individual performance (grade) is assessed in light of the reflection paper on the group work and the actual participation in the oral presentation.
- Active participation in the discussion of the topic (at least 5 x oral participation, with each topic discussion counting separately)
- Active participation in the discussion of the reflection questions per session, prepared in terms of content (at least 3 x participation)
