Aims, contents and method of the course

Hans Kelsen’s Pure Theory of Law (2nd Ed. 1960) is one of the most influential works in 20th century legal theory. This seminar is dedicated to this classic. What are its groundbreaking innovations, what is still relevant today, and which are the points where a contemporary reader would dissent? We will treat these questions using excerpts from Pure Theory, contrasting them with critical views on the subject. The seminar will thus deal with the following topics:

3. Recht und Wissenschaft, RR 72-107.
4. Recht, Unrecht und Sanktion, RR 114-150.
5. Der Begriff der Rechtsperson, RR 162-196.
6. Die Grundnorm, RR 196-228.
7. Der Stufenbau der Rechtsordnung, RR 228-242, 261-280.
8. Rechtsanwendung und Interpretation, RR 242-261, 346-352.
9. Recht und Staat, RR 283-319.
10. Staat und Völkerrecht, RR 321-343.
11. Was ist Gerechtigkeit? (1953, Reclam 2000)
12. Die Reine Rechtslehre im Kontext des Gesamtwerks: Demokratietheorie, Philosophie und Soziologie Kelsens.

Assessment and permitted materials

Für Diplomand*innen: Seminararbeit (entsprechend den Vorgaben der Fakultät) und 20-minütiger Vortrag.
Für Doktorand*innen und Wahlfachanrechnungen: 20-minütiger Vortrag.

Minimum requirements and assessment criteria

Anwesenheit bei allen Terminen, Abhalten des Vortrags, rechtzeitige Abgabe der Seminararbeit.
