Aims, contents and method of the course
The course is primarily addressed to students wishing to approach that particular field of law usually called ‘labour’ or ‘employment’ law from a perspective different than their own national law. The progressive blurring of nation-State boarders in regulation the many aspects of contemporary societies became more and more urgent also in the regulation of employment relationships and the main legal institutions thereof. However, instead of focusing on supranational sources of regulation (international treaties, ILO Conventions and Recommendations, or even EU law) to didactically explain a world of work increasingly multifaceted, this course is centred on the richness and complexity of national experiences of labour law, in the ultimate conviction that the study of basic concepts of labour law through the transsystemic methodology may allow readers to grasp cross-fertilization of different models while keeping their diversity. This may also serve as an antidote against a superficially globalising approach to the regulation of labour relations, especially across European countries. The steering function of EU harmonization law and policies, in fact, should not bring to underestimate the importance of different traditions and legal formants in the single system.
Assessment and permitted materials
The assessment is based on two partial performances:
1. Solution of one or more case studies (80%)
2. Active participation in class (20%)

Minimum requirements and assessment criteria
Attendance is compulsory. Students may miss no more than one class (with apologies for important reasons two classes). Attendance in the first lesson is absolutely necessary otherwise the spot will be given to students on the waiting list (exceptions can be made for important reasons with prior excuse).
For a positive assessment of the course, attendance and the achievement of 50,5 % of the assessment criteria are necessary.

The contents of the course are the following:
1. Introduction to labour law. Origins, Sources, General principles. (8 March 2023) – 2 TU2. Collective bargaining and the collective agreement – 3 TU3. Subjects: the worker. Distinctions employee/worker/self-employed. The concept of subordination. The contract of employment. Worker’s obligations. – 3 TU4. Subjects: the employer. Employer’s powers and prerogatives (direction, control, discipline) – 3 TU5. Flexible employment contracts. In particular: fixed-term contracts. The sanction of requalification– 3 TU6. Remuneration. Basic income and minimum wage. – 3 TU7. The termination of the employment relationship. Individual dismissals (typology). Unfair dismissal protections. – 3 TU
