Aims, contents and method of the course

1. Überblick über die Entwicklung der Grundrechte und des Grundrechtsschutzes in Österreich unter Mitberücksichtigung der europäischen und internationalen Entwicklung

2. Überblick über die in der österreichischen Rechtsordnung geltenden Grund- und Menschenrechte

3. Grundrechtstheorien, Grundrechtsinterpretation und Grundrechtsdogmatik

4. Grundrechtspolitik und Grundrechtsgesetzgebung

5. Darstellung zentraler Grundrechtsbestimmungen anhand von Wissenschaft und Praxis

6. Innerstaatlicher Grundrechtsschutz (gerichtlicher und kommissarischer)

7. Europäischer Menschenrechts- und Grundrechtsschutz (EMRK/EGMR, Grundrechtecharta/EuGH) und sein Verhältnis zum innerstaatlichen Grundrechtsschutz

Ziel der Vorlesung ist, den Studierenden Entwicklung, Geltung, Theorie und Dogmatik der Grundrechte und des Grundrechtsschutzes in Österreich, sowie das Verhältnis des nationalen Grundrechtsschutzes zum Schutz der Grund- und Menschenrechte durch EU, Europarat und Vereinte Nationen darzulegen
