Aims, contents and method of the course

The Digital Markets Act (DMA) is a central component of the EU's efforts to ensure the competitiveness and fairness of the European digital economy. With the DMA, the European Union is responding to the growing power and influence of large digital platforms - the so-called “gatekeepers” - whose dominant market position increasingly inhibits innovation, puts smaller providers at a disadvantage and restricts consumer rights. The aim of the DMA is to create a fair and competitive environment in which small and medium-sized enterprises (SMEs) have access to the market and innovation is promoted. The DMA also aims to strengthen consumer protection and ensure citizens' freedom of choice within the digital single market.
The DMA is part of a broader EU regulatory strategy to promote a sustainable and fair digital economy. It complements the Digital Services Act (DSA), which focuses on the content and responsibility of online platforms, the General Data Protection Regulation (GDPR) on the protection of personal data and the planned Artificial Intelligence Regulation (AI Regulation), which aims to ensure the ethical and safe use of AI. The Digital Single Market Directive (DSM Directive) also plays a role in shaping this digital ecosystem by protecting rights holders and promoting fair remuneration models in the digital space. The seminar traces these developments.
Remark: Attending this seminar serves in particular to prepare students for writing a thesis with Prof. Jaeger following the successful completion of the seminar and is therefore particularly recommended for students who are considering writing a thesis with Prof. Jaeger.

Assessment and permitted materials

The seminar comprises a written seminar paper and an oral presentation followed by a discussion. It primarily serves as preparation for a thesis, which is, however, a separate performance following the seminar (based on the seminar paper) and assessed separately from it.
