Aims, contents and method of the course

First unit: Allocation of topics and information about presentations and seminar papers
Second (interim) unit: In-depth discussion of citation rules and requirements for seminar papers; presentations if required (e.g. due to Erasmus absences in June)

By attending the course, students should get the opportunity to deepen their knowledge in certain areas of medical law. A list of possible topics includes:

- Special aspects of the professional law of the health care
- Types of medical service provision (GP practice, group
practices, primary care units, other medical service providers, hospitals)
- Healthcare planning
- Market access regulations in the health care system (e.g. needs
tests for pharmacies, hospitals and group practices)
- Legal provisions on quality assurance in medical treatment
- The marketing authorization procedure for medicinal products
- The donation of blood, organs and tissues
- Coercive measures during medical treatments
- Confidentiality, notification and reporting obligations
- Health telematics law, especially electronic health record
(EHR) ELGA
- The law of epidemics, "Covid-19 legislation”
- Discussion of (current) court decisions on medical law (Austrian
Supreme Court, Administrative and Constitutional Law, ECHR,
ECJ), to be found for example in the journal "RdM/Recht der
Medizin"

These topics are to be understood as mere suggestions, individual topic suggestions are highly welcome. It is also possible to cover partial aspects of the topics listed above.

Assessment and permitted materials

As this is a seminar, all participants are invited to present their chosen topic in a 20-minute (time discipline!) presentation, which should introduce the other participants to the essential questions of the chosen topic. In addition, a seminar paper must be written and submitted towards the end of the semester. The paper has to comply with the quality criteria of the curriculum for diploma seminars (the text including footnotes and blank spaces must comprise at least 50,000 characters; the paper must also include a table of contents, a bibliography and, if necessary, a list of abbreviations). Furthermore, participation in the discussions after the presentations is expected.

Minimum requirements and assessment criteria

Completion of the course Medical Law I compulsory, completion of Medical Law II is strongly recommended, depending on the chosen topic.
Personal attendance is mandatory, including the first and second unit.

Examination topics

Oral 20-minute presentation, written seminar paper of 25 - 30 pages (as required by the curriculum: text and footnotes shall comprise at least 50,000 characters including spaces), participation in the discussion.

Reading list

The independent search for literature is part of the student performance to be evaluated, but I will be available for advice in the preliminary discussion.

General guidance on how to write a seminar paper can be found in these books: Konrath (ed.), Schreib Guide Jus (5th edition 2022), Kerschner, Wissenschaftliche Arbeitstechnik für Juristen (7th edition 2022).
