Aims, contents and method of the course

The "ethics of law" is dedicated to the task of evaluating the law from a moral point of view. Particularly visible fields of application are the application of the considerations of medical or animal ethics to law. The background for the moral evaluation of law is essentially formed by two competing currents of normative ethics: the consequentialism on the one hand and the so-called "deontological" approaches on the other. The competition between these currents must be considered against the background of the question of whether something like "objectivity" of moral judgement can exist at all and how it should be imagined. This "meta-ethical" question is still controversial today. The seminar is devoted to normative ethics and the positions of metaethics in relation to law.

Compulsory attendance at all dates (Anwesenheitspflicht bei allen Terminen), Oral presentation on a topic of the seminar, seminar paper of roughly 12-15 pages, unless you decide to prepare a „Diplomseminararbeit“

Compulsory attendance at all dates , Participation at the discussion. seminar paper of roughly 12-15 pages, deadline for the paper: end of the semester, unless you decide to prepare a „Diplomseminararbeit“. However, a "Diplomseminararbeit" can only be written after submission of a letter of motivation and consultation with Prof. Somek.

Examination topics

Papers of the presentations of the participants with subsequent discussion.

For introduction is recommended: Herlinde Pauer-Studer, Einführung in die Ethik (2. Aufl. 2013); Andrew Fisher, Metaethics (2011).
A first introductory reading will be announced in the preliminary meeting. Further documents will be made available in moodle.
