Information

Aims, contents and method of the course

The seminar will focus on current developments in European and international civil procedure law. The seminar will focus on the recent case law of the European Court of Justice and relevant legal policy developments at EU level (and their implementation by national legislators).

In accordance with the thematic orientation of the seminar, it will take place in an international context in cooperation with the University of Sassari or University of Padua. Accordingly, the seminar topics will be examined from a multinational perspective, whereby the perspective of Austrian procedural law represents only one of the dimensions to be explored.

The aim of the course is, on the one hand, to learn the independent scientific analysis and presentation of legal problems by writing and presenting a seminar paper; on the other hand, there will be an intensive exchange and discourse with legal scholars from other jurisdictions.

In the preliminary meeting on Thursday, 14.03.2024, from 10.00 - 11.00, the topics of the seminar will be discussed and assigned to the students. Further details on the joint arrival and departure (if desired) to Sardinia or Padua will also be clarified.

Assessment and permitted materials

All entries will be judged, all resources are allowed.

Minimum requirements and assessment criteria

- seminar paper of approx. 20-25 pages (if the paper is to be submitted as a thesis seminar paper: min. 50.000 characters, excl. table of contents, list of abbreviations and bibliography).
- Short presentation of 15-20 minutes, with handout or slides
- Attendance during the entire seminar
- Submission of the final version of the seminar paper by the end of the semester.

The seminar grade is based on equal weighting of oral (presentation, participation) and written performance (seminar paper). The diploma thesis seminar grade evaluates only the written seminar paper.

Examination topics

An examination on the material is not foreseen within the framework of a seminar.

Reading list

The literature relevant to the topic is compiled within the framework of independent research. The course instructor offers various forms of assistance (research tutorials, etc.).
