Aims, contents and method of the course

In the seminar, conditions for the development of the modern understanding of law shall be explored in comparative perspective. Focal topics will be: reception of Roman Law, Common Law and precedent, codification movements and evolving distinction between private law and public law in Civil Law tradition, concept of law and methodological discourse since the 19th century, esp. historical school and "Begriffsjurisrudenz", "interest" and "evaluative" jurisprudece, legal positivism and "free law school", methodological aspects of Nazi jurisprudence, legal principles (“natural law”) and constitutionalism since WW II, theory and interpretation of fundamental rights, concept of individual rights in the German and French legal traditions and in contemporary European law; constitutionalisation of international law.
Topics for individual presentations will be assigned in the preparatory meeting.

Assessment and permitted materials

Oral presentation on a topic of the seminar, seminar paper of roughly 8-10 pages, unless you decide to prepare a „Diplomseminararbeit“. The much more demanding requirements for the Diplomseminararbeit will be set out on the Moodle page.
