Aims, contents and method of the course

The idea of legal pluralism challenges legal scholarship. How did the concept of legal pluralism develop? What exactly does it mean? What criticism(s) are there? And where do we find legal pluralism?

In a first step, the seminar deals with the debates on legal pluralism as they have developed in legal anthropology and the sociology of law since the 1960s. It provides insights into the theoretical debates and asks about their significance for law and society. In a second step, concrete constellations of legal pluralism and the controversies surrounding them will be examined. We will ask what is being negotiated here: law? rights? politics?

Assessment and permitted materials

Students are asked to give a presentation of 20-25 minutes and to prepare a handout with the main arguments and findings. The possibility to write diploma seminar papers (50,000 characters) is given. Doctoral students are also welcome.

The seminar is held bilingually (German/English). You can give your presentation in one of the two languages and choose between the two languages in the discussion. The same applies to the seminar paper.

Minimum requirements and assessment criteria

Attendance and active participation are expected during the entire seminar.

Examination topics

Students will be expected to prepare a presentation for class discussion.

Reading list

A few keywords and important sources of literature will be introduced to the students. However, most of the literature discussed in this seminar will be accumulated through individual research.
