Information

Aims, contents and method of the course

This course is focusing on the legal standing of Islam in Austria. International legal aspects are taken into account in so far as Islam in Austria is shaped by a so-called "migrant background". The sources of fundamental rights, which are relevant for the law governing religion in Austria (especially Basic Law 1867, State Treaty of St. Germain 1919, European Convention on Human Rights 1950) will be particularly examined.
The Islam Act 1912 and the Islam Act 2015 will also be discussed.
With regard to state law currently in Force, there are numerous topics, that will also be examined (e.g. Anti-Face-Cavering-Act 2017; the legal standing of Muslims in working life and the restriction of the possibility to construct minarets in two federal provinces).
Furthermore, recent incidents likte the "Operation Luxor" or the establishment of the "Dokumentationsstelle Politischer Islam" will be discussed.

Assessment and permitted materials

Compulsory attendance, resentation of 20 minutes.
A written assignment has to be drawn up by graduands, doctoral students and students of International Legal Studies.

Minimum requirements and assessment criteria

Students who do not comply with the compulsory attendance in a noticeable way ore are not present at the first course unit without a valid excuse will be deregistered. If there is a minor extent of attendance an additional oral colloquium can be demanded.

Examination topics

Primarily depending on the presentation topic.

Reading list

A course-document will enable an initial introduction to the literature. This document willbe uploaded in an updated version on the moodle plattform after the preliminary discussion.
Nevertheless, independent research is an essential part of the course and influences the final score.
