Aims, contents and method of the course

This seminar deals with the legal recognition of religious communities in Austria. Even though the Law on the Recognition of Religious Communities has passed its 150th anniversary in 2024, the subject matter has not lost any of its relevance. Especially the Law on the Registration of Confessional Communities 1998 has considerably added to the regime of legal recognition of religious communities.
The course will set the following focal points:
.) The procedure concerning the legal recognition of the religious community of German Catholics in the context of the revolution 1848
.) The legal status of legally recognised religious communities in accordance with the Basic Law on the General Rights of Citizens 1867
.) The background and content of the Law on the Recognition of Religious Communities 1874
.) The recognition of the Old Catholic Church in 1877
.) The Law on Islam 1912 and the recognition of the followers of the hanafite rite
.) The requirements to the legal recognition of religious communities introduced by the Law on the Registration of Confessional Communities 1998
.) The long road to the legal recognition of Jehova's Witnesses
.) The conditions for ending legal recognition of religious communities added in 2011
.) The recognition of the "Freikirchen in Österreich" in 2013
.) The legal recognition of Islamic religious communities according to the Law on Islam 2015
.) The European Court of Human Rights' influence on the legal recognition of religious communities

Assessment and permitted materials

Compulsory attendance, oral collaboration, presentation of 20 minutes.
A written assignment has to be drawn up by graduands and doctoral students.

Minimum requirements and assessment criteria

Students who do not comply with the compulsory attendance in a noticeable way or are not present at the first course unit without a valid excuse will be deregistered. If there is a minor lack of attendance an additional oral colloquium may be required.

Examination topics

Primarily depending on the presentation topic.

Reading list

A course-document will provide an initial introduction to the literature. This document will be uploaded in an updated version on the moodle plattform after the preliminary discussion.
Nevertheless, independent research is an essential part of the course and influences the final score.
