Aims, contents and method of the course

Aims: the students obtain basic knowledge on the legal protection of software and software contract law. This will enable them to solve legal problems and draft software specific contracts and contract clauses.

Contents: This course covers selected topics of software law, such as non-performance, liability and specific software-related aspects of the contractual practice.

Method of the course: Lecture, case examples, assignment

Practice Report: Dr. Lukas Feiler, SSCP, CIPP/E, partner and head of the IP and IT team at Baker McKenzie in Vienna (on Friday 06.12.)

Assessment and permitted materials

Written final exam (closed book), assignment (task contract drafting), active participation

Minimum requirements and assessment criteria

Minimum requirements: A minimum of 10 points is required for the successful completion of the course.

Assessment criteria:
• Assignment (task contract drafting): 5 points
• Final exam: 15 points
• Active participation: additional points, 1 per class

The course grade depends on the number of points achieved in total:
1 (very good) = from 18 points (90% or more)
2 (good) = 15,5 to 17,5 points (77,5 – 87,5%)
3 (satisfactory) = 13 to 15 points (65 – 75%)
4 (sufficient) = 10 to 12,5 points (50 – 62,5%)
5 (not sufficient) = under 10 points (less than 50%)
