By providing the legal framework for monitoring the subsidies granted by the EU Member States to their private undertakings, State aid rules aim at ensuring a level playing field among the companies active within the internal market. State aid rules, therefore, complement the EU competition rules included in Art 101 and 102 TFEU. The course analyses the EU State aid rules included in Art 107 and 108 TFEU. In particular, the course discusses the interpretation of the EU Court of Justice (ECJ) in relation to these provisions of the Treaty, as well as the Decisions and the Guidelines adopted by the EU Commission in enforcing EU State aid rules. Finally, the course discusses recent developments in this area, like the enforcement of State aid rules in the context of the financial crisis, and the modernization of State aid procedural rules.

The course is suitable for students interested to deepen their knowledge and understanding of EU law, in a specific policy area like State aid law.

Aims, contents and method of the course

Assessment and permitted materials

Students will be divided in groups. During the last 3 classes, every group will be required to give an oral presentation in front of the class (max. 20 minutes). The teacher will provide the students with a list of possible topics for presentations during the first class. The number of students per group depends on the number of students enrolled in the course.
A final written exam will take place at the end of the course.
Assessment:
- Oral presentation (25% final mark)
- Final written exam (75% final mark).

Reading list

The teacher will provide to the students the text of relevant legislation and case law discussed during the classes. In addition, students will be asked to read before each class some selected chapters from the textbooks mentioned below. All the reading materials will be made available to the students via Moodle platform.
