Information

Aims, contents and method of the course

Expansion of knowledge of the subject by applying it to cases. Revision and advanced discussion on the core curriculum by means of practical exercises. Case analysis and explanation of complex issues.
Excursion to the Commercial Court Vienna followed by discussion of the cases.

Assessment and permitted materials

1 written exam or homework and oral participation.

Minimum requirements and assessment criteria

The final grade will be a result of the written as well as the oral performance during the course of the lecture. More to be announced.

Examination topics

Thematische Schwerpunkte der Übung sind das Erkenntnisverfahren (JN, ZPO, AußStrG) und das Exekutionsverfahren (EO). Insbesondere werden erörtert: Zulässigkeit des Rechtswegs, Inländische Gerichtsbarkeit, Internationale Zuständigkeit, Zuständigkeit, Parteilehre, Klage, Streitgegenstand, erstinstanzliche Verfahren, Beweisrecht, Urteilslehre, Rechtsmittelrecht, Rechtsmittelklagen, allgemeiner Teil des Exekutionsverfahrens und die Fahrnis- bzw die Forderungsexekution.
