Aims, contents and method of the course

Especially in the area of dispute resolution, looking beyond one's own legal system opens up interesting perspectives. The course is therefore conducted in cooperation with the Universities of Heidelberg and Lausanne. The aim of the course is to learn the independent scientific analysis and presentation of legal problems. The object of study is, on the one hand, questions of international civil procedure law and, on the other hand, current legal problems that have developed in the "DACH region", e.g. in case law and doctrine, or that have arisen due to changes in the law. Suggested topics will be made available in the preliminary discussion; however, students' own suggestions can also be considered.

Goals: Deepening of methodological knowledge; exchange of ideas in an international environment; development of critical thinking; strengthening of the ability to present orally and to deal with complex legal issues in writing.

Method: Interactive and Socratic in the form of written elaboration, oral presentation and joint discussion of the topics.

Topics:

- Current developments in international civil procedure law (international jurisdiction, cross-border enforcement, interim relief)

- Procedural law institutes in legal comparison

- National and international civil procedure law in crisis mode

Assessment and permitted materials

All entries will be judged, all aids are allowed.

Minimum requirements and assessment criteria

Seminar paper of approx. 20-25 pages (if the paper is to be submitted as a thesis seminar paper: min. 50,000 characters, excl. table of contents, list of abbreviations and bibliography).

Short presentation of 15-20 minutes, with handout or slides
Attendance during the entire seminar
Submission of the final version of the seminar paper by 1 July 2023

The seminar grade is based on equal weighting of oral (presentation, participation) and written performance (seminar paper). The diploma thesis seminar grade only evaluates the written seminar paper.
