Aims, contents and method of the course

Content:
Arbitration plays an important role as an alternative to the jurisdiction of state courts, especially in international trade and commerce. Many people are not sufficiently aware of this and are therefore unable to take advantage of the benefits of choosing arbitration later in their careers, especially with regard to confidentiality, flexibility and speed. Moreover, international best practice has developed in this area, which is in large part characterised by Anglo-American principles (document production, cross-examination).
This very internationally oriented course familiarises students with the practical side of arbitration proceedings and explains the core principles and milestones derived from the extensive experience of the lecturer who has acted as an arbitrator, party representative and is a member of the presidium of the Vienna International Arbitral Centre. This course will convey knowledge of Austrian and international arbitration law (arbitration agreements, selection of arbitrators, course of arbitration) as well as legal protections against arbitral awards, the Austrian legal situation and international aspects, in particular the relatively easy worldwide enforcement possibility of an arbitral award under the New York Convention.
Objective:
After completing this course, students should have a practically applicable overview of the practice of arbitration.

Assessment and permitted materials

The performance assessment is based on oral participation (10% = 4 points) and two written examinations in German (45% each = 18 points each) at the end of the course. A passing grade is obtained by achieving 21 points. Information on the permitted aids for the examinations can be found at: http://privatrecht.univie.ac.at/

Minimum requirements and assessment criteria

Attendance is compulsory throughout. Students may be released from compulsory attendance for a total of one unit for an important reason. Attendance is compulsory for the 1st unit without exception. Students who do not appear will be deregistered from the course, unless there is an important provable reason for their absence (apology and proof before the 1st unit to Prof. Irene Welser; Irene.Welser@cerhahempel.com).

A passing grade is obtained by achieving 21 points. Grade key: 21-25 points - sufficient, 26-30 points - satisfactory, 31-35 points - good, 36 points upward - very good.
