An online preliminary meeting will take place via Moodle (Mon, 01 March 2021, 15:00-16:30). There will be two online exams, the first exam will be held on 26.04.2021 and the second exam will be held on 03.05.2021.

Information

Aims, contents and method of the course

This course focuses on the fundamentals of Austrian private foundation law. The participants will be given an overview of the legal nature, the establishment and the motives for the establishment of a private foundation. Furthermore, the legal status of the founder and the beneficiaries will be discussed.

After completing this course, students will have a basic knowledge of Austrian private foundation law and will be able to independently solve simple legal questions in this context.

Assessment and permitted materials

The performance assessment is based on participation (max. 10% = 4 points), as well as two written exams in German (45% each = 18 points each, duration of each exam: 45 min) at the end of the course, whereby both exams are held as online exams.
At the end of each unit there will be a voluntary participation test, which contains three questions about the content of the respective unit. If two or more answers are correct, the test is passed. A positive participation test corresponds to one participation point, whereby a maximum of four participation points can be achieved during the course!
If 21 points are reached, the course is completed positively.

Copying from the Internet or from textbooks in the case of online open-book examinations and the use of an annotated law text or labeled post-its in the case of presence examinations is considered unauthorized (information on the use of unauthorized aids can also be found at https://privatrecht.univie.ac.at/service-news/schummeln/).

Minimum requirements and assessment criteria

In principle, attendance is compulsory throughout. Students can be released from compulsory attendance for a total of one unit for an important reason. In the 1st unit (online preliminary meeting via Moodle on 01 March 2021 15:00-16:30) attendance is compulsory without exception. Students who do not show up will be deregistered from the course, unless there is an important provable reason for their absence (excuse and proof before the 1st unit to Mr. Markus Edelsbrunner; markus.edelsbrunner@univie.ac.at).

From 21 points on, the course is positively completed. Grade key: from 21 points - 4, from 26 points - 3, from 31 points - 2, from 36 points - 1.
