Information

Aims, contents and method of the course

Due to the COVID 19 pandemic, changes to courses may be necessary at short notice. You will be informed of such changes in good time.

Taking into account the international orientation of economic activity, this course offers an introduction to the law of the European Union and private international law. With special consideration of the areas of Union law relevant to business (in particular fundamental freedoms), an overview of the functioning and principles of the European Union and Union law is first provided. In addition, a case-related presentation of the basic rules of private international law is given with a focus on the provisions of international contract law, knowledge of which is indispensable for determining the applicable substantive law in cross-border situations.
The aim of the course is to provide students with an overview of the legal implications of international legal transactions, which should also serve as a basis for economic activities in the international field in their later professional life.

The units on the European Law part (09.03.2022, 16.03.2022, 23.03.2022, 30.03.2022, 06.04.2022, 27.04.2022 and 04.05.2022) will take place from 11.30-13.00 hrs. Attendance is compulsory on these dates.

The units on IPR (11.05.2022, 18.05.2022, 25.05.2022, 01.06.2022, 08.06.2022 and 15.06.2022) will take place from 11.30-13.00. Participation is compulsory.

Assessment and permitted materials

The performance review/assessment is based on the participation in the units (10% = 8 points). Four cooperation points can be achieved in Private International Law and European Law. A maximum of one cooperation point can be earned per unit and a total of no more than eight.
Furthermore, there are two written examinations in German (45% = 36 points each, duration of each examination: 90 minutes) at the end of the course. With regard to the exams, please note that both the first exam on 19.01.2022 and the second exam on 26.01.2022 will be held in presence.
The course is positively completed with 41 points or more.
Copying from the internet or from textbooks in the case of online open-book examinations and the use of an annotated law text or written post-its in the case of presence examinations is considered unauthorised (information on the use of unauthorised aids can also be found at https://privatrecht.univie.ac.at/service-news/schummeln/).

Minimum requirements and assessment criteria

There will be a preliminary meeting on 02.03.2022 at 11.30 am. Attendance is compulsory for this meeting. Non-participating students will be deregistered from the course unless there is an important and provable reason for their absence (excuse and proof before the first unit by e-mail to Mr. Edelsbrunner; markus.edelsbrunner@univie.ac.at).

Attendance is compulsory for all units of the course, whereby two unexcused absences will be tolerated (apologies and proof before the respective unit by e-mail to Mag. Edelsbrunner; markus.edelsbrunner@univie.ac.at).
