Information

Aims, contents and method of the course

Content:
General: Legal basics in the field of e-commerce; economic and social connections;
Inclusion of legal issues in cross-border business transactions on the Internet.
In particular:
Contract law on the internet; consumer protection in distance contracts; financial services on the internet; information duties; liability for information on the net; unsolicited messages; provider liability; domain law; legal issues of online marketing; signature law; blockchain and smart contracts; dispute resolution in case of a (cross-border) legal dispute; current legal issues and socio-political developments in e-commerce.
After completing the course, students will be able to recognise basic legal problems associated with the commercial use of the Internet and independently assess simple legal issues.
Furthermore, they know the most important legal provisions for electronic legal transactions and their systematic interplay; they understand the technical, political and economic basics of electronic legal transactions; they are able to solve practical cases with relevant legal problems.

Assessment and permitted materials

Die Leistungskontrolle/Beurteilung erfolgt aufgrund eines Kurztests (10 % = 8 Punkte) im Kurs, sowie zweier Klausuren in deutscher Sprache (je 45 % = je 36 Punkte, Dauer je Klausur: 60 Minuten) am Ende des Kurses. Durch die Beteiligung an den jeweils am Ende der 2. bis 4. LV-Einheit stattfindenden Diskussionsrunden können bis zu 6 Zusatzpunkte erworben werden. Es werden insgesamt maximal 80 Punkte vergeben.
Unkommentierte Gesetzestexte und nicht elektronische Wörterbücher dürfen bei den Klausuren verwendet werden.

Minimum requirements and assessment criteria

Grundsätzlich besteht durchgehende Anwesenheitspflicht. Aus einem wichtigen Grund können Studierende für insgesamt eine Einheit von der Anwesenheitspflicht entbunden werden. In der 1. Einheit besteht ausnahmslos Anwesenheitspflicht. Nicht erschienene Studierende werden vom Kurs abgemeldet, es sei denn, für ihr Fehlen liegt ein wichtiger belegbarer Grund vor (Entschuldigung und Nachweis vor der 1. Einheit an Herrn Prof. Blocher: blocher@uni-kassel.de).

Ab > 50 % (= 41 Punkte) ist der Kurs positiv absolviert. Notenschlüssel: ab 41 Punkte - genügend, ab 51 Punkte - befriedigend, ab 61 Punkte - gut, ab 71 Punkte - sehr gut).
