Aims, contents and method of the course

Die Lehrveranstaltung Miet- und Wohnrecht bietet einen Überblick über den rechtlichen Rahmen der Wohn- und Geschäftsraummiete. Im Mittelpunkt der Lehrveranstaltung steht die Übermittlung von Kenntnissen im Bereich des Miet- und Bestandrechts.
Nach einer Gesamtdarstellung des österreichischen Bestandrechts wird der Aufbau und der Anwendungsbereich des Mietrechtsgesetzes dargelegt und auf Fragen des Kündigungs- und des Preisschutzes - samt den einzelnen Mietzinsbildungsvorschriften- eingegangen.
Im Fokus steht die Darstellung der Geschäftsraummiete und des bei ihr- im Regelfall zur Anwendung kommenden -angemessenen Mietzins in Abgrenzung zur Unternehmenspacht. Darüber hinaus werden die speziell für Unternehmen anwendbaren mietrechtlichen Normen, insbesondere Mietzinsanhebungsrechte im Falle einer Unternehmensveräußerung oder eines Machtwechsels im Unternehmen erläutert.

Ziel dieser Lehrveranstaltung ist es, den Studierenden ein Grundverständnis für eine Vielzahl an mietrechtlichen Normen zu vermitteln. Durch die Erarbeitung kleiner Fälle werden theoretische Kenntnisse auch in praxisrelevanter Form angewandt.

Assessment and permitted materials

The student's performance is based on oral Participation(4 points), two written online tests on Moodle (2x 18 points each) of 45 minutes.

Six multiple-choice tests will be given on Moodle to monitor participation. These are available on Friday after each unit. One test can be completed at a time, with 20 minutes available for each. One cooperation point can be earned per test (prerequisite: more than 50% of the questions answered correctly). A maximum of four Mitarbeit points can be earned in the course. About the possibility to get 2 additional points, I refer to the Moodle course.

Minimum requirements and assessment criteria

There is compulsory attendance throughout the course, but students may be released from this obligation for a total of one unit for good cause. In the 1st unit, attendance is compulsory without exception. Students who do not show up will be deregistered from the course, unless there is an important provable reason for their absence (excuse before the 1st unit to Mr. Grundei, gregor.grundei@univie.ac.at).

From 21 points the course is positively completed. Grade key: from 21 points - 4, from 26 points - 3, from 31 points - 2, from 36 points - 1.

The exam material corresponds to the literature given below. The focus is on the slides provided.
A collection of laws is useful (Kodex Bürgerliches Recht).
