Aims, contents and method of the course

The course provides an overview of the legal framework of the Austrian tenancy and property law (digital).
After an overall presentation of Austrian tenancy law, the first block of the course presents the structure and the scope of application of the Tenancy Law Act and deals with questions of termination and price protection.
The focus is on the presentation of the rent for business premises and the appropriate rent that is usually applied to it, as opposed to the rent for business premises. In addition, the norms of landlord and tenant law that are specifically applicable to companies, in particular the right to raise the rent in the event of a sale of the company or a change of power within the company, are explained.
The second major block of the course provides basic knowledge of residential property law, a special form of co-ownership. Here, in particular, objects suitable for condominium ownership, rights and obligations of the condominium owners, maintenance and repair obligations are dealt with. In addition, the nature of the owners' association, a legal entity with partial legal capacity, which can acquire rights and enter into obligations in matters of property management, is explained.
At appropriate points, excursions into cross-sectional matters will be sought.
The aim of this course is to provide students with a basic understanding of a variety of tenancy law standards. By working on small cases, theoretical knowledge is also applied in a practical way.
Students will receive a script at the beginning of the course. In addition, some fact sheets are prepared for better understanding.

Assessment and permitted materials

Die Leistungskontrolle erfolgt aufgrund von mündlicher Mitarbeit = 4 Punkte sowie zweier Klausuren ( je 18 Punkte, Dauer je Klausur: 45 Minuten) in deutscher Sprache am Ende des Kurses. Ab 21 Punkten ist der Kurs positiv absolviert.
Maximal können in dem Kurs vier Mitarbeitspunkte erlangt werden. Über die Möglichkeit 2 Zusatzpunkte zu erlangen, verweise ich auf die Moodle-Kursseite.

Die Verwendung eines kommentierten Gesetzestextes oder beschriftete Post-its bei den Püfungen gilt als unerlaubt (Information über die Verwendung unerlaubter Hilfsmittel finden Sie auch unter https://privatrecht.univie.ac.at/service-news/schummeln/).

Minimum requirements and assessment criteria

There is compulsory attendance throughout the course, but students may be released from this obligation for a total of one unit for good cause. In the 1st unit, attendance is compulsory without exception. Students who do not show up will be deregistered from the course, unless there is an important provable reason for their absence (excuse before the 1st unit to Mr. Grundei, gregor.grundei@univie.ac.at).

From 21 points the course is positively completed. Grade key: from 21 points - 4, from 26 points - 3, from 31 points - 2, from 36 points - 1.

Examination topics

Der Schwerpunkt (nicht der Prüfungsstoff!) der Klausuren liegt auf den im Kurs durchgenommenen Inhalten.

Prüfungsstoff ist die unten angegebene Literatur. Für die Erarbeitung wohnrechtlicher Fragestellungen bietet sich der Kodex bürgerliches Recht an.
