Aims, contents and method of the course

Content:
This course aims to provide basic knowledge of insolvency law. In addition to an introduction to the function and concern of the legal field in question, the persons and bodies involved, the prerequisites for opening insolvency proceedings and the substantive insolvency law, specifically the effects of opening insolvency proceedings and the main features of the right of avoidance, are to be explained in more detail. In addition, legal reorganization options in the event of corporate insolvency as well as the main features of the reorganization plan and the reorganization procedure will be presented, and the specific provisions for the insolvency of a natural person will also be presented and discussed. Finally, the course will address specific issues related to corporate and commercial law for companies in crisis (EKEG, liability of board members, etc.) and for mergers and acquisitions transactions in crisis.

Objectives:
To provide the fundamentals of insolvency law and other important aspects of the company in crisis.

Method:
Face-to-face lecture.
The course materials for the individual course units are made available to the students according to the specified time and topic schedule of the course (available via the Moodle platform), so that the chosen structure and the desired content of the course can be ensured. After the uploading of the respective documents the students can access them at any time. In any case, the documents made available remain online until the end of the course.

Assessment and permitted materials

Students can achieve a total of 80 points in the course: 72 points are awarded in the two examinations , 8 points can be obtained through participation in the course units. Examination: written examinations with open questions; duration 90 minutes each.
Grade key for the course: from 41 points grade 4, from 51 points grade 3, from 61 points grade 2, from 71 points grade 1.
