Aims, contents and method of the course

Content:
Structure and procedure of judicial civil proceedings as well as of court proceedings in general;
Possibilities of extrajudicial litigation, e.g. before private arbitration courts; international arbitration; arbitration clauses;
Rules of jurisdiction of civil courts; international jurisdiction; commercial jurisdiction;
Appeals against decisions of the courts; evidentiary procedure and distribution of the burden of proof;
Duty of counsel; legal aid; legal costs;
Enforcement of court judgments; execution proceedings;
Objectives:
Practice-based understanding of law enforcement.
Methods:
Lecture by the course instructor, student participation in the course, assignments. The course will be very practice-oriented and (if possible) excursions will be scheduled (especially visits to court hearings).

Assessment and permitted materials

2 written examinations, cooperation, homework (drafts of judgments), Presentations. Unannotated law texts and dictionaries (all in non-electronic form) may be used in the examinations.

Minimum requirements and assessment criteria

Attendance is compulsory in the 1st unit without exception. Students who do not show up will be dropped from the course unless there is an important provable reason for their absence. (Apologies and proof before the 1st unit to Dr. Schwarzenbacher: erich.schwarzenbacher@univie.ac.at).
Basic requirement for positive completion: 40 of 100 points
