Aims, contents and method of the course

The transfer of western legal concepts and models was part of the reform of Chinese law both at the beginngen and the end of the 20th century. Therefore, the question of legal transplants is a crucial one in the course of modernisation of the Chinese legal system.

Assessment and permitted materials

presentation (powerpoint) and paper (15 to 20 pages), discussion (based on reading assignments).

Minimum requirements and assessment criteria

Looking at concepts like constitutionality, (human) rights and intellectual property the seminar deals with theoretical and practical aspects of transfering western law to China.

Examination topics

Working on the theoretical and historical background based on related texts.
Presentations (individual) and discussion on special issues.
Summing up and further illustrating the findings by way of films related to the topic.
