Aims, contents and method of the course

Aims: The aim of this class is to introduce students to the principles and methods of international dispute resolution with a focus on international commercial litigation. Through case-studies students should gain a theoretical understanding of the interplay between these various means and the strategic choices involved when deciding where and how to resolve a dispute. It is such a holistic view that should enable students to take into account business interests and short-term, mid-term and long-term goals when making these choices.
Contents:
This course introduces the principles underlying different methods and the processes involved in dispute resolution along with their relative strategic advantages and disadvantages. The main focus is on transnational litigation but will also take into account links to and compare it with arbitration, mediation and negotiation.
Method: Lecture, class discussion and in-class group work

Assessment: Written exam
Permitted materials: open-book exam

Minimum requirements and assessment criteria

50% for a positive grade, based on the written exam
