Aims, contents and method of the course

Aims: Introduction to European Common Commercial Policy
Contents: This course provides an overview of the Common Commercial Policy (CCP) of the European Union. It starts with an analysis of the scope of the exclusive EU competence for the conduct of the CCP which, still somewhat controversially, also encompasses Foreign Direct Investment (FDI), as well as of the legal foundations, especially the relevant treaty-provisions and rulings of the ECJ on the objectives and powers related to the CCP. The course then examines the status of relevant International Agreements in EU Law as well as the role of the EU as a Customs Union pursuing its trade policy objectives by means of the conclusion of international agreements as well as autonomously. Topics to be covered include ECJ case law on the interpretation and review of the legality of international agreements, the legal status of WTO agreements in EU law, EU trade defense instruments (antidumping, countervailing duties) as well as classification, valuation and origin of goods.
