Information

Aims, contents and method of the course

The principles and potential relationships of Austrian Building and Planning Law are taught, as well as the constitutional background, relevant legal sources, hierarchy of norms, European Community Law, relevant administrative procedures and legal remedies. Overview of institutions of Building Law, federal legislation, administrative authorities, competences and levels of appeal, constructions, administrative procedures, parties to the proceedings and current case law by the supreme courts Constitutional Court and Administrative Court to selected and current issues. Discussion of the Spatial Planning legal regulations, legal framework and relevance for planners as well as recent case law. Furthermore, a survey carried out on environmental planning regulations, RVP, SEA, EIA, EIA and transport, environment report, EIS, EIA Directive, SEA Directive and on the implementation and enforcement of Community law.
Insight into the practice, preparation and presentation of legal issues, discussion of current case law, independent research of literature, laws and relevant case law, working with legal databases.
Keynote speeches by course tutor and elaboration of individual legal areas by short presentations of students and further discussions.
